Terms of Service

Effective Date: September 7th, 2025

Welcome to Eventic! These Terms of Service (“Terms”) are a legal agreement between you and Eventic (“we,” “our,” “us”) governing your use of our event management and ticketing platform (the “Services”).

By creating an account, purchasing a ticket, or otherwise using the Services, you agree to these Terms. If you do not agree, you may not use Eventic.

1. Roles and Responsibilities

Eventic provides technology that enables event organizers (“Organizers”) to create events, sell tickets, and process registrations. Individuals who attend or register for events are “Attendees.”

• Organizers are solely responsible for their events, ticket sales, refunds, taxes, and compliance with applicable laws.
• Attendees contract directly with the Organizer when registering for or purchasing a ticket to an event. Eventic is not a party to this agreement.
• Eventic acts only as a platform provider and payment facilitator.

2. Eligibility & Accounts

• You must be at least 18 years old to create an Organizer account.
• You agree to provide accurate information and maintain the security of your login credentials.
• If you act on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Payments, Refunds, and Taxes

• Payment Processing: Payments are handled by third-party providers such as Stripe, Apple Pay, or Google Pay. Eventic does not store or control payment card data.
• Refunds: All refunds and cancellations are the sole responsibility of the Organizer. Eventic is not liable for, and does not guarantee, any refunds. Attendees must contact Organizers directly for refund requests.
• Chargebacks: Organizers are responsible for disputes and chargebacks.
• Taxes: Organizers are solely responsible for determining, collecting, and remitting applicable taxes (sales tax, VAT, GST, etc.). Eventic does not provide tax advice.

4. Use of the Services

You agree not to use Eventic to:

• Violate any law, regulation, or third-party rights.
• Host or promote illegal, fraudulent, defamatory, obscene, violent, or dangerous events.
• Distribute malware, spam, or unauthorized commercial communications.
• Resell or transfer accounts without authorization.
• Attempt to hack, disrupt, or reverse-engineer our systems.

Violation may result in suspension or termination.

5. Intellectual Property

• Your Content: You retain ownership of the content you upload. You grant Eventic a limited license to use it as necessary to provide the Services.
• Eventic Content: All software, trademarks, logos, and materials are owned by Eventic or its licensors. You may not copy, modify, or distribute them without permission.

6. Privacy

Our Privacy Policy is incorporated into these Terms by reference. By using Eventic, you also agree to our Privacy Policy.

7. Service Availability & Force Majeure

We strive for reliable uptime but do not guarantee uninterrupted service. Access may be suspended due to maintenance, outages, or events beyond our control (e.g., natural disasters, strikes, internet failures, government actions).

8. Disclaimers of Warranties

To the fullest extent permitted by law, Eventic provides the Services “AS IS” and “AS AVAILABLE” without warranties of any kind.

We specifically disclaim responsibility for:

• Event quality, legality, safety, or cancellations.
• Attendee conduct or Organizer conduct.
• Refunds, disputes, or chargebacks.
• Unauthorized access, hacking, or data breaches.
• Payment instrument compromise.
• Service interruptions or technical errors.
• Loss of revenue, opportunities, or reputation.

9. Limitation of Liability

To the maximum extent permitted by law:

• Eventic and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, goodwill, or data.
• Eventic’s total liability in any claim shall not exceed:

(a) The total fees you paid to Eventic in the six months before the claim, or

(b) USD $100, whichever is greater.

You waive any right to seek damages beyond this limit.

10. Indemnification

You agree to indemnify and hold harmless Eventic, its affiliates, and personnel from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from:

• Your events or tickets,
• Your breach of these Terms, or
• Your violation of any law or third-party rights.

11. Termination

We may suspend or terminate your access at any time for violations, fraud, or legal reasons. After termination, your rights to use the Services cease immediately, but liability limitations and indemnities survive.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Insert State/Country]. Disputes shall be resolved exclusively in the courts of [Insert Jurisdiction], unless otherwise required by consumer laws.

13. Changes to Terms

We may update these Terms periodically. Updates will be posted with a new “Last Updated” date. Continued use of Eventic after changes constitutes acceptance.

14. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and Eventic.
• Severability: If any provision is found invalid, the rest remain in force.
• No Waiver: Our failure to enforce a provision does not waive our rights.
